Lippes Mathias Wexler Friedman LLP Attorney Kevin Burke recently authored a column for the Buffalo Law Journal, in which he discussed the First Amendment right to free speech.
In his column, Mr. Burke discusses how hate speech is typically protected under the Constitution, unless it considered threatening or "fighting words." Mr. Burke specifically cites the controversy involvingTown of Evans resident Scott Boyler, who was arrested after allegedly posting offensive comments about police on the Internet.
