Lippes Mathias attorneys Scott V. Carroll and Jameson E. Tibbs presented at the Home Care Association of New York State Corporate Compliance Symposium, which was held on November 8, 2023, in Schenectady, N.Y. Carroll and Tibbs’ presentation, titled “Artificial Intelligence in Home Healthcare and Legal and Compliance Issues,” included a background discussion about the various types of artificial intelligence (AI), machine learning and automation applications and their related technologies and a review of the general legal authorities that apply to artificial intelligence and AI governance principles. The presentation also covered the additional legal requirements that apply to AI applications in healthcare, including existing and proposed standards issued by the Federal Drug Administration (FDA) and HHS Office of the National Coordinator for Health Information Technology and other legal requirements that are applicable, including the HIPAA Privacy and Security rules. Carroll and Tibbs also explored some areas of potential automation in home health care and reviewed associated legal issues.
Scott V. Carroll, partner and co-leader of Lippes Mathias’ health care practice team, brings more than 20 years of experience in the healthcare and life sciences practice group to his clients. He has represented everything from health plans, medical groups, hospitals, and integrated delivery systems to pharmaceutical and medical device manufacturers, research institutes, and specialty service organizations. Jameson E. Tibbs, leader of Lippes Mathias’ artificial intelligence practice team, assists clients with copyright matters, including licensing, protecting music, art and software; trademark matters; and patent matters in the technical fields of electrical engineering and computer science with a specific focus on artificial intelligence and adaptive systems.
