Mr. Niebling concentrates his practice primarily on energy and environmental issues, focusing on a wide range of regulatory, transactional, land use, and infrastructure development matters. He has experience working with the U.S. Environmental Protection Agency (EPA) and the Departments of Energy, Interior, State, and Transportation on legal and policy matters and issues arising under the Clean Air Act, the Administrative Procedures Act, and numerous other environmental statutes. Drawing from his past experience as a high level political appointee at EPA, senior staffer for several U.S. Senators, and a Legislative Assistant for the Senate Committee on Foreign Relations, Mr. Niebling also works closely with the firm’s Public Law & Policy and Government Investigations & Enforcement Actions practices.
Prior to joining Lippes Mathias, Mr. Niebling served on the political leadership team at the U.S. EPA’s Office of Air and Radiation, where he provided legal and policy advice on the Clean Air Act, various high profile regulations including the Clean Power Plan, environmental permitting issues, civil rights compliance, and tribal issues. While at the EPA, he also was primarily responsible for managing the EPA’s interactions with Congress on air quality and climate change issues, which included preparing witnesses for more than two dozen congressional hearings and responding to Congressional oversight requests, letters, and inquiries.
Before and following law school, Mr. Niebling served in a variety of senior professional roles for Senators Kamala Harris, Joe Biden, and Ted Kaufman, and as Legislative Assistant to the Senate Committee on Foreign Relations, with a broad policy portfolio that has included tax, appropriations, and budget issues; economic and labor issues; transportation and infrastructure; energy, climate, and environmental protection; communications, agriculture, immigration, and a range of other issues. During law school, he interned in the Office of General Counsel for the U.S. Department of Energy. Immediately prior to joining Lippes Mathias, Mr. Niebling served as Research Counsel with the Environmental and Energy Law Program at Harvard Law School.
